CUSTODIAL SENTENCE

THIRD PARTIES
There are various third parties offences,
relating to prostitution ie
Causing or Inciting another person,to
become a prostitute for gain
Pimp and/or Pandering
Controlling the activities of another person,
relating to that person's prostitution for gain.

A pimp is the term that refers to a person
who controls prostitute(s),in exchange for
FINANCIAL GAIN.
Usually a male,but could quite easily be a
female,arranges the liaisons between a
PROSTITUTE and a CLIENT,in exchange
for a fee or sexual reward or both,but
usually for nothing,as all the prostitutes
earnings end up with the pimp anyway
A person found guilty of
EXPLOITING a PROSTITUTE
in this way,may be liable to serve
a PRISON SENTENCE as per
The Criminal Justice Act 2003
The length of the sentence
will be decided
a) Willingness of the Prostitute
b) Involvement and Level of
EXPLOITATION Inflicted on the
Prostitute
c) Mental and Physical Coercion
of the Prostitute
Expect to receive a Prison Term
of between Two-Five years
LOITERING and SOLICITING
The Street Offences Act 1959
1(a) it shall be an offence for a
person aged 18 or over,whether
male or female PERSISTENTLY
to loiter or solicit in a street or
public place,for the purpose of
prostitution
4(a) for the purpose of this section
Conduct is Persistent,if it takes
place on two or more occasions
in any
PERIOD of THREE MONTHS
4(c) street includes any
bridge,road,lane,footway,subway,
square court,alley or passage,
whether a thoroughfare or not
which is for the time being open
to the public and the
doorway and entrances of
premises abutting on a street,
and any ground adjoining and
open to a street
shall be treated as forming part
of a street.
Prostitution is illegal,as per
the legislation,set out in the
above mentioned (1959) Act
This means a prostitute and/or
a (female) will be breaking UK
law,if they attempt to solicit or
wait for customers/clients in a
PUBLIC PLACE
including,on streets,in alleyways
or within discreet public areas.
Prostitutes,who break UK
soliciting laws,may be liable
for punishment,including
FORMAL CAUTIONS,ARREST,
CRIMINAL CHARGES.

Repeated Offenders,are more
likely to receive an 'anti social
behaviour order (ASBO)
which is a Police Caution

Sexual Offences Act 1985
(repealed) replaced by the
Policing and Crime Act 2009
any person who attempts to
solicit the services of a prostitute
from a vehicle,
whilst driving on a street,or in
a public area,is breaking UK law
(1) A man commits an offence,
if he solicits a woman or
(different women) for the purpose
of prostitution
(a) from a motor vehicle,while it
is in a street or public place
(b) in a street or public place
while in the immediate vicinity
of a motor vehicle,that he has
just got out of,persistently or
subject to section 5(b) in such
manner or in such circumstances
as to be likely to cause annoyance
to the woman or (any woman)
solicited,or nuisance to other
person's in the neighbourhood
2(1) a man commits an offence,
if in a street or public place,he
persistently solicit a woman or
(different women) for the purpose
of prostitution
PENALTIES
for those found to be kerb crawling
there is a £1.000 fine and
DISQUALIFICATION from driving
and an (ASBO) a Civil Injunction
or an Acceptable Behaviour
Contract
VIOLENCE AGAINST THOSE
INVOLVED IN PROSTITUTION.
Those who sell sex (male/female)
are often targets of violent crime,which can include physical
and sexual attacks,
which include and often does
involve Rape
Offenders,deliberately target those
who sell sex,because they believe
they will not REPORT THE CRIME
to the police
Perpetrators of such offences,can
include Clients and the actual Pimp
Prostitution and Exploitation
of Prostitution.
Abuse of power,used by those
that incite and control prostitution,
the majority of whom are men,
to control the selling of sex,the
majority of whom are women

for those who recruit (groom)
others into prostitution,for their
own gain or someone else's are
inciting or controlling prostitution
for gain or trafficking for
SEXUAL EXPLOITATION
these offences,provide for the
SEIZURE OF ASSETS,through
Proceeds of Crime Act orders
and the application of
Trafficking Prevention orders
virtue of the Proceeds of Crime
Act 2002
Offences of loitering,soliciting,
kerb crawling,paying for sexual
services and advertising of
prostitution,
are all Summary Offences

PAYING FOR SEXUALSERVICES
OF A PROSTITUTE SUBJECT
TO EXPLOITATION
Sexual Offences Act 2003 s53A
makes it an offence for a person
to pay or promise payment for
SEXUAL SERVICES of a
prostitute
who has been subject to
EXPLOITATIVE CONDUCT.
OFFENCES
a person (A) commits an offence
(a) A makes or promises payment
for the sexual services of a
prostitute (B)
(b) a third person (C) has engaged
in exploitative conduct of a kind
likely to induce or encourage B
to provide the sexual services for
which A has made or promised
payment,and
(c) C engaged in that conduct for
or in the EXPECTATION of GAIN
for C or another person
(apart from A or B)
EXPLOITATIVE CONDUCT
is conduct which involves the use
of:force,threats
(whether or not relating to violence)
any other form of coercion: or any
FORM of DECEPTION.
CONTROLLING A PROSTITUTE
FOR GAIN.
Sexual Offences Act 2003 s53
s53(1) a person commits an
offence if,
a) he intentionally controls any
of the activities of another person
relating to that person's
prostitution,in any part of the
world,and
b) he does so,for the or in the
EXPECTATION OF GAIN for
himself,or a THIRD PARTY.
GAIN (defined)
Any financial advantage,including
the discharge of an obligation to
pay or the provision of goods or
services (including)
SEXUAL SERVICES
gratuitously or at a discount:or
The goodwill of any person which
is or appears likely,in time,to bring
FINANCIAL ADVANTAGE

CONTROL
includes,but is not limited to:
compulsion,coercion,and force:
it is enough,that the person acted
acted UNDER the INSTRUCTIONS
or DIRECTION of the Defendant
SENTENCING
on summary conviction,a person
is liable to imprisonment,for a
term not exceeding six months or
a fine,
not exceeding the statutory
maximum or both,
on conviction,on indictment,
a person is liable,to imprisonment
for a term,not exceeding seven
years.
TRAFFICKING for SEXUAL
EXPLOITATION
Modern Slavery Act 2015.
creates an offence of arranging or
facilitating,the travel of another
person,
for the purposes of
SEXUAL EXPLOITATION.
A person commits an offence,
if he ARRANGES or FACILITATES
the victim's TRAVEL by recruiting
them,Transporting and Transferring them.or
harbouring or receiving them,with
a view to the victim being exploited
in any part of the world.
JUDICIAL SENTENCING
A Custodial Sentence is a
judicial sentence,imposing a
punishment consisting of
MANDATORY CUSTODY of
the convict
this is either in prison or some
other closed therapeutic or
educational institution.
As "Custodial" suggest,
the sentence requires the
suspension of an individual's
LIBERTY and the
ASSUMPTION of responsibility
over the individual,by another
body or institution.
The Criminal Justice Act 2003
states,
"the court must not pass a
custodial sentence,unless it is of
the opinion that the offence,or the
combination of the offence and
one or more offences associated
with it,
was so serious that neither a fine
alone nor a community sentence
can be justified for the offence"

SEX FOR RENT
The rogue landlords,who offer 'free rooms'
in return for "favours" and what are the
favours required.
To the unaware average person (female) or
(male),the true meaning of some of the phrases
or phrasing,used on the adverts,placed in shop
windows,local gazette,or posted on the local
library and of university notice board
could be missed
"rooms for rent are offered in exchange for
"benefits" or "keeping me company"
Other adverts,are less subtle,
"free accommodation in exchange for
erotic arrangement"

renting rooms for 'sexual favours',is now seen
as a growing menace,by some campaigners,ie
these adverts are aimed to attract a student,
a foreign female,low income/homeless female,
or the single mother etc
One can argue,that the system has let them
down,where there is a housing shortage,and
many people,which include young male/female
are unable to find somewhere to live,without
having to spend exorbitant sums in rent.
the problem has become particularly apparent
in university towns,where young women are
targeted by these rogue landlords and such an
offer,may actually breach the Sexual Offences
Act 2003
The LAW
Offering accommodation in
exchange for sex,is inciting
prostitution,
an offence which can carry a
sentence of up to seven years
imprisonment.
"agreeing to have sex with
someone,under the pressure
and fear of homelessness,or
in exchange for the basic right
to have somewhere to live,
does not equate to agreeing by
choice,any sexual activity without
consent,is a very serious offence
JUDICIAL SENTENCING (Rape)
Rape carries a maximum
sentence of life imprisonment.
single offence of rape
by a single offender is five years,
if the victim is sixteen or over
eight years,if the victim is
thirteen or over,but under sixteen
years old
ten years,if the victim is
under thirteen years old
Rape accompanied by aggravating
factor,is eight years imprisonment
if the victim is sixteen or over
ten years imprisonment,
if the victim is thirteen years
or over but,under sixteen
thirteen years imprisonment
if the victim is under thirteen
years old,
Repeated rape of the same
victim,by a single offender,or
rape of the victim,involving
multiple victims
carries fifteen years imprisonment
